Air Press Media is a Georgia-based marketing company that helps small businesses understand what marketing they actually need, develop a strategy, and execute it.


These Terms & Conditions (“Terms”) apply to your use of the Air Press Media website and, where applicable, your purchase of services through the website.


Your individual proposal, statement of work, service agreement, or other written agreement with Air Press Media may contain additional terms specific to your project. If there is a conflict between these website Terms and a signed client agreement, the signed client agreement will control for that specific engagement.

1. OUR APPROACH

Small businesses don't all need the same marketing.

Our goal is not to sell you every service we offer.

We work with you to understand:

  • Where your business is today

  • Where you want to go

  • Who you are trying to reach

  • What marketing you're already doing

  • What's working

  • What's not working

  • What your budget allows

  • What should happen now

  • What can wait

 

We then recommend the services and level of support that we believe best fit your goals.

 

A recommendation is not a guarantee of a particular business result.

 

2. OUR SERVICES

Air Press Media may provide:

  • Marketing consultations

  • Marketing strategy

  • Social media management

  • SEO

  • Google Business Profile management

  • Paid advertising

  • Email marketing

  • Blog writing

  • Website design and development

  • Branding

  • Logo design

  • Marketing design

  • Photography and visual content

  • Educational programs

  • Courses and workshops

  • Other marketing or creative services agreed upon in writing

 

Not every service is appropriate for every business.

Services provided to you will be determined by your applicable proposal or agreement.

 

3. PROPOSALS AND CLIENT AGREEMENTS

 

Before beginning a project or ongoing service, we may provide a proposal, estimate, package description, statement of work, invoice, or service agreement.

 

Your agreement may specify:

  • Services

  • Deliverables

  • Timeline

  • Project milestones

  • Fees

  • Payment schedule

  • Revision limits

  • Client responsibilities

  • Third-party expenses

  • Cancellation terms

  • Other project-specific requirements

 

Only services specifically included in your agreement are included in the project fee.

 

4. ELECTRONIC AGREEMENTS

Air Press Media may conduct business electronically.

You may receive proposals, contracts, invoices, approvals, and other documents electronically.

Where applicable, an electronic signature or electronic acceptance may constitute your agreement to the applicable document.

Georgia law provides that an electronic record or signature generally cannot be denied legal effect solely because it is electronic. (Justia Law)

When you electronically sign or accept an agreement, you should retain a copy for your records.

 

5. PRICING

Prices displayed on our website are intended to provide general information and may represent starting prices.

Your actual investment may vary based on:

  • Scope

  • Complexity

  • Number of deliverables

  • Frequency

  • Timeline

  • Platforms involved

  • Business requirements

  • Third-party costs

 

Your proposal or service agreement will identify the price applicable to your specific engagement.

 

No surprise scope changes.

 

If you request work outside the agreed scope, we will communicate the additional work and applicable fee before proceeding whenever reasonably practical.

 
6. PAYMENT

Payment terms will be stated in your proposal, invoice, package, or service agreement.

Depending on the service, payment may be:

  • One-time

  • Milestone-based

  • Monthly

  • Recurring

  • Based on another agreed schedule

 

You are responsible for paying invoices according to the agreed payment terms.

If an account becomes past due, Air Press Media may pause services after reasonable notice until the account is brought current.

 

7. MONTHLY SERVICES

For ongoing marketing services, the applicable agreement will identify:

  • Monthly services

  • Deliverables

  • Billing schedule

  • Start date

  • Cancellation requirements

  • Any minimum commitment

Monthly services do not automatically include every Air Press Media service.

 

If your business needs additional work outside the monthly scope, we will discuss that with you before performing significant additional work.

 

8. CANCELLATION

Monthly Services

Unless your service agreement states otherwise, either party may end an ongoing monthly service arrangement with 30 days' written notice.

 

You remain responsible for services properly performed during the applicable notice period.

Project Services

For one-time projects, cancellation will be governed by the applicable proposal or service agreement.

Work completed before cancellation may remain payable.

 

Third-party expenses already incurred on your behalf may also remain payable.

 

9. REFUNDS

Because marketing and creative services involve time, planning, labor, and resources, refunds are handled based on the specific service and applicable agreement.

Unless otherwise stated in writing:

  • Completed services are not refundable.

  • Work already performed is not refundable.

  • Approved deliverables are not refundable.

  • Third-party expenses may not be refundable.

  • Advertising spend paid to third parties is generally not refundable by Air Press Media.

 

If a refund applies under your agreement, it will be processed according to that agreement.

 

We do not intend this policy to limit any cancellation or refund right that cannot legally be waived.

 

10. CLIENT RESPONSIBILITIES

Marketing works best when both sides participate.

You agree to provide information, access, materials, approvals, and feedback reasonably necessary for us to perform your services.

 

This may include:

  • Business information

  • Brand assets

  • Logos

  • Photos

  • Videos

  • Website access

  • Social-media access

  • Advertising-account access

  • Google Business Profile access

  • Product/service information

  • Content

  • Approvals

  • Feedback

 

You are responsible for ensuring that information you provide is accurate and that you have the right to provide and use the materials.

 

11. CLIENT APPROVALS

You are responsible for reviewing materials submitted for approval.

Once a deliverable has been approved, changes that substantially alter the approved work may be considered additional work.

Examples include:

  • Changing an approved concept

  • Requesting a completely new design

  • Adding new website pages

  • Adding functionality

  • Rewriting approved content

  • Changing project requirements

  • Requesting additional campaign materials

We will communicate additional scope and fees before significant additional work whenever reasonably practical.

 

12. PROJECT TIMELINES

We will establish reasonable project timelines based on the agreed scope.

Timelines may be affected by:

  • Client delays

  • Missing information

  • Late approvals

  • Third-party platforms

  • Technical issues

  • Scope changes

  • Unforeseen circumstances

If you delay a project, the original completion date may need to be adjusted.

 

13. PAUSED OR DELAYED PROJECTS

If a project becomes inactive because required information, approvals, access, or materials have not been provided, Air Press Media may place the project on hold.

 

We will make reasonable efforts to communicate with you before closing or significantly rescheduling a project.

If a closed or substantially delayed project is restarted, the timeline, availability, and scope may need to be reassessed.

Additional charges will be discussed before significant restart work is performed.

 

14. MARKETING RESULTS

We work toward the goals established with you.

 

However, no marketing company can guarantee a specific business outcome.

 

Air Press Media does not guarantee:

  • A specific number of customers

  • A specific number of leads

  • A specific amount of revenue

  • Specific Google rankings

  • A specific advertising return

  • Specific social-media growth

  • A specific website traffic level

  • A specific conversion rate

 

Results can be affected by factors outside our control, including competition, market conditions, pricing, customer demand, platform algorithms, advertising costs, business operations, and your sales process.

 

Our commitment is to provide the agreed strategy and services professionally—not to promise an outcome we cannot control.

 

15. SEO

SEO results can take time and vary by business.

Air Press Media does not guarantee:

  • First-page rankings

  • A specific ranking position

  • A specific amount of traffic

  • A specific number of leads

  • A specific revenue increase

 

Search engines may change algorithms, ranking factors, policies, and features without notice.

 

We will use reasonable professional efforts to perform the SEO services included in your agreement.

 

16. PAID ADVERTISING

Advertising budgets and Air Press Media's service fees are separate unless your agreement states otherwise.

You may be responsible for paying advertising platforms directly.

Air Press Media does not guarantee:

  • Ad approval

  • Ad placement

  • Cost per click

  • Cost per lead

  • Conversion rates

  • Sales

  • Return on advertising spend

Advertising platforms can change policies, pricing, algorithms, targeting options, and account requirements.

 

17. THIRD-PARTY PLATFORMS

Our services may involve third-party platforms such as:

  • Wix

  • Google

  • Meta

  • Instagram

  • Facebook

  • TikTok

  • LinkedIn

  • Email platforms

  • Advertising platforms

  • Hosting providers

  • Domain providers

  • Analytics services

  • Payment processors

  • Scheduling platforms

  • Stock-media providers

 

These companies operate independently from Air Press Media.

 

We cannot guarantee that third-party services will remain available or maintain their current:

  • Features

  • Pricing

  • Policies

  • Algorithms

  • Security requirements

  • Functionality

 

Third-party fees are the client's responsibility unless specifically included in your agreement.

 

18. WEBSITE PROJECTS

For website projects, the proposal or statement of work will identify the agreed scope.

Unless specifically included, website services may not include:

  • Domain registration

  • Hosting

  • Premium applications

  • Paid plugins

  • Stock photography

  • Premium fonts

  • Third-party software

  • Ongoing maintenance

  • Ongoing SEO

  • Advertising

  • Future content updates

You are responsible for reviewing the website and providing final approval before launch.

 

19. INTELLECTUAL PROPERTY

You retain ownership of materials you provide to Air Press Media, including your:

  • Business name

  • Logo

  • Trademarks

  • Original photographs

  • Original videos

  • Brand materials

  • Written content

 

You represent that you have the right to provide those materials to us.

Air Press Media retains ownership of its pre-existing:

  • Templates

  • Processes

  • Strategies

  • Methodologies

  • Tools

  • Internal materials

  • Proprietary systems

  • Unused concepts

 

Upon full payment, ownership or usage rights for final deliverables will be transferred or licensed as described in your applicable agreement.

 

Third-party materials remain subject to their applicable licenses.

 

20. CLIENT CONTENT

You are responsible for ensuring that materials you provide do not unlawfully:

  • Infringe copyrights

  • Infringe trademarks

  • Violate privacy rights

  • Violate publicity rights

  • Defame another person or business

  • Violate applicable law

 

Air Press Media may decline to publish or use content that we reasonably believe creates a legal, ethical, or platform-policy concern.

 

21. CONFIDENTIAL INFORMATION

We understand that small-business owners may share confidential information with us.

We will take reasonable steps to protect confidential business information and will use it for legitimate business purposes related to the services we provide.

 

Confidential information may be shared with service providers when reasonably necessary to perform the agreed services.

 

Confidential information does not include information that is:

  • Publicly available

  • Already lawfully known to us

  • Independently developed

  • Required to be disclosed by law

 

Additional confidentiality obligations may be established through a separate agreement.

 

22. CLIENT DATA AND PRIVACY

If Air Press Media processes personal information on your behalf, additional requirements may apply.

You are responsible for ensuring that you have appropriate permission and legal authority to provide customer or prospect information to Air Press Media.

 

Our handling of information collected through our website is described in our Privacy Policy.

23. EDUCATIONAL CONTENT

Air Press Media may provide educational content, including:

  • Articles

  • Courses

  • Workshops

  • Webinars

  • Guides

  • Templates

  • Marketing resources

Educational content is for general informational purposes.

It is not legal, tax, accounting, financial, or other professional advice.

 

24. TESTIMONIALS AND PORTFOLIO USE

 

With your permission, Air Press Media may request to use your:

  • Business name

  • Logo

  • Testimonial

  • Project

  • Website

  • Marketing materials

in our portfolio, case studies, website, social media, or other promotional materials.

 

We will not knowingly represent that you endorse Air Press Media without appropriate authorization.

 

25. WEBSITE USE

You agree to use our website lawfully.

You may not:

  • Attempt unauthorized access

  • Interfere with website operation

  • Introduce malicious code

  • Misuse website systems

  • Copy proprietary materials for commercial use without permission

  • Use the website to violate applicable law

We may modify or discontinue portions of the website when necessary.

 

26. FAIR AND TRANSPARENT BUSINESS PRACTICES

Air Press Media strives to communicate its services, pricing, limitations, and business practices accurately.

We do not intend to make false or misleading claims about our services, pricing, capabilities, or results.

Georgia's Fair Business Practices Act prohibits unfair or deceptive acts or practices in covered consumer transactions. (Georgia Consumer Protection)

 

Nothing in these Terms is intended to waive rights that cannot legally be waived.

 

27. DISCLAIMER OF WARRANTIES

To the extent permitted by law, Air Press Media does not guarantee that:

  • The website will always be available

  • The website will be error-free

  • Third-party platforms will remain available

  • Marketing platforms will operate without interruption

  • Marketing results will meet a particular expectation

 

Services will be performed according to the applicable agreement and reasonable professional standards.

 

Nothing in these Terms excludes a warranty or legal right that cannot legally be excluded.

 

28. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Air Press Media will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.

For a specific paid engagement, and to the extent permitted by law, Air Press Media's aggregate liability will not exceed the amount actually paid to Air Press Media for the services giving rise to the claim.

This limitation does not apply to liability that cannot legally be limited or excluded.

 

29. THIRD-PARTY PLATFORM ISSUES

Air Press Media is not responsible for losses resulting primarily from a third-party platform's actions, including:

  • Account suspension

  • Algorithm changes

  • Service outages

  • Policy changes

  • Advertising disapproval

  • Search-engine changes

  • Platform security incidents

  • Third-party pricing changes

 

We will make reasonable efforts to assist with issues that fall within the scope of our services.

 

30. INDEMNIFICATION

To the extent permitted by law, you agree to be responsible for claims arising from materials or information you provide to Air Press Media when those claims result from your lack of authorization or violation of another person's rights.

 

This does not require you to indemnify Air Press Media for our own unlawful conduct or obligations that cannot legally be transferred to you.

 

31. GOVERNING LAW

These Terms are governed by the laws of the State of Georgia, except where applicable federal or other mandatory law provides otherwise.

 

32. DISPUTE RESOLUTION

If a dispute arises, we encourage both parties to first attempt to resolve the matter directly and in good faith.

Nothing in these Terms prevents either party from pursuing rights or remedies available under applicable law.

 

33. ATTORNEY'S FEES

Attorney's fees or collection costs will apply only when provided for in a valid written agreement and to the extent permitted by applicable law.

 

34. CHANGES TO THESE TERMS

Air Press Media may update these Terms periodically.

The updated Terms will include a new effective date.

Changes to these website Terms do not automatically modify an existing signed client agreement.

 

35. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

 

36. ENTIRE AGREEMENT

These website Terms and our Privacy Policy govern your general use of the Air Press Media website.

 

For paid services, your signed proposal, statement of work, service agreement, invoice, or other applicable agreement may establish additional terms.

 

The signed client agreement controls when it conflicts with these general website Terms.
